Terms of Service

These Terms of Service ("Terms") are an agreement between you and Propsell Estate Services LLP ("Propsell", "we", "us"), the operator of propsell.co. They govern your use of the Propsell portal — browsing listings, creating an account, posting properties, sending enquiries, and using our home loan tools. By using the portal you accept these Terms. If you do not accept them, please do not use the portal.

1. What Propsell Is (and Is Not)

  • Propsell is an online platform where property owners, agents, and builders publish listings, and where visitors discover properties and connect with the people who posted them.
  • Propsell is not a party to any transaction between users. We do not own the listed properties, do not act as your broker or agent, do not verify title or approvals, and do not negotiate or guarantee any deal.
  • Propsell Estate Services LLP and members of its team may themselves post listings or act as real estate agents for specific properties. Where they do, they act in that separate capacity as the poster of those listings, on the same terms as any other user, and the portal's role as a platform remains unchanged.
  • Home loan tools (calculators, indicative bank rates) are informational. Loan sanction, rates, and terms are decided solely by the lender.

2. Accounts and OTP Login

  • You register and sign in with your mobile number, verified by a one-time password sent on WhatsApp. Keep your number active and your device secure — activity from your logged-in session is your responsibility.
  • You must provide true, current, and complete information and be at least 18 years old.
  • You may not impersonate another person or operate accounts to evade a suspension.

3. Listing Rules

  • Post only properties you own or are authorised to market. We may ask for proof of ownership or authority at any time.
  • Listing information must be accurate and not misleading — price, area, photos, availability, and legal status included.
  • Prohibited: fake or duplicate listings, unapproved projects presented as approved, discriminatory conditions barred by law, content that infringes others' rights, and anything unlawful.
  • Listings are moderated. We may reject, edit for formatting, unpublish, archive, or remove a listing at our discretion, and listings expire or archive automatically after their display period.
  • Listing on Propsell is currently free. If we introduce paid services, their prices and terms will be disclosed before you buy anything.

4. Enquiries and Contact Sharing

  • When you send an enquiry on a listing, your contact details and message are delivered to the person who posted it (or the advisor managing that listing) so they can respond to you. When you submit a home loan enquiry, your details may be shared with our partner banks and lenders.
  • Your consent is taken with each enquiry and a timestamped record of it is stored — see the Privacy Policy.
  • Contact details revealed to you are for that property discussion only. Bulk harvesting, scraping, resale of leads, and unsolicited marketing to numbers obtained on Propsell are prohibited.

5. Acceptable Use

In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, publish, or share on the portal any content that:

  • is unlawful, defamatory, obscene, pornographic, paedophilic, or invasive of another person's privacy;
  • is insulting or harassing on the basis of gender, or racially or ethnically objectionable;
  • encourages money laundering, gambling, or any other unlawful act;
  • is harmful to children;
  • infringes any patent, trademark, copyright, or other proprietary right;
  • deceives or misleads about the origin of the message, or knowingly communicates false or misleading information;
  • impersonates another person;
  • threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or incites any offence;
  • contains a virus or any code designed to disrupt, damage, or limit any computer resource.

In addition, on this platform:

  • No fraudulent or abusive activity of any kind.
  • No attempts to probe, breach, overload, or reverse-engineer the platform, bypass rate limits or moderation, or access other users' accounts or administrative systems.
  • No automated scraping or data extraction, except lawful search-engine indexing of public pages.
  • No misuse of the OTP system, enquiry forms, or contact channels.

We may remove content and act on accounts that violate these rules, including on receipt of a valid court or government order as the IT Rules require.

6. Your Content

You keep ownership of the content you post. You grant Propsell a non-exclusive, royalty-free licence to host, display, resize, reformat, and distribute that content on the portal, in search results and feeds, and in marketing of the platform, for as long as the listing remains on the portal. You confirm you hold the rights needed to grant this licence.

7. Our Content

The Propsell name, logo, design, software, and portal content (other than user listings) belong to Propsell Estate Services LLP and may not be copied or reused without written permission.

8. Third-Party Services

The portal relies on third-party services — for example WhatsApp for OTP delivery, analytics providers, and partner banks. Those services are governed by their own terms, and we are not responsible for them.

9. Disclaimers

  • The portal is provided "as is" and "as available". We do not warrant uninterrupted availability, error-free operation, the accuracy of any listing, or that any enquiry will lead to a response or a transaction.
  • Independently verify every property — title, approvals, RERA registration, measurements, pricing, and the identity of the person you deal with — before paying or signing anything. See our Disclaimer page.

10. Limitation of Liability

To the maximum extent permitted by law, Propsell is not liable for indirect, incidental, or consequential losses, loss of profit or data, or for disputes and transactions between users. Our total liability for any claim related to the portal is limited to the amount (if any) you paid Propsell for the specific service giving rise to the claim.

11. Indemnity

You agree to indemnify Propsell against claims and losses arising from your listings, your conduct on the portal, or your breach of these Terms or of applicable law.

12. Suspension and Termination

We may suspend or terminate accounts and remove content for breach of these Terms, legal risk, fraud, or abuse. You may stop using the portal and request account closure at any time — the Privacy Policy explains what we retain afterwards.

13. Governing Law and Disputes

These Terms are governed by the laws of India, and competent courts in India will have jurisdiction, subject to applicable law. Please raise grievances first through our Grievance Redressal process.

14. Changes

We may update these Terms; the date above shows the latest revision. Material changes will be notified on the portal, and continued use after the effective date means you accept the updated Terms.
