Propsell (propsell.co) is operated by Propsell Estate Services LLP ("Propsell", "we", "us"). This Privacy Policy explains what personal data we collect when you browse the portal, create an account, post a property, or send an enquiry — and how we use, share, and protect it. It is written to align with the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology Act, 2000.

1. Data We Collect

  • Account data: your name, mobile number, email address, and role (owner, agent, or builder). Your mobile number is verified with a one-time password (OTP) delivered on WhatsApp.
  • Listing data: property details, address and locality, photos and videos, pricing, availability, and the contact details you choose to publish with a listing.
  • Enquiry data: when you contact a listing or request a home loan callback — your name, phone number, email, message, the property or loan details you enquired about, and a timestamped record of the consent you gave.
  • Builder verification documents: if you register as a builder, we collect company details and verification documents (such as RERA registration, GST, PAN, or company registration proof). These are used solely to verify your builder account, are stored privately, are accessible only to you and our verification team, and are retained while your builder account remains active or as the law requires.
  • Usage data: pages viewed, searches made, device and browser information, and approximate location derived from your IP address.
  • Communication records: OTP delivery status, notifications we send you, and support conversations.

2. How We Use Your Data

  • Creating and securing your account (WhatsApp OTP login, session management).
  • Publishing and moderating property listings, including checks for duplicate, misleading, or prohibited content.
  • Delivering your enquiries to the right recipient and enabling them to respond to you.
  • Sending service notifications about your listings, enquiries, and account.
  • Measuring and improving the portal — analytics, performance, and search quality.
  • Preventing fraud, spam, and abuse, and complying with legal obligations.

3. Who Receives Your Enquiry

This is the most important data sharing on the portal, so we spell it out clearly:

  • Property enquiries: your name, phone number, email, and message are shared with the person who posted the listing (the owner, agent, or builder) — or with the advisor managing that listing where Propsell manages contact — so they can respond to you.
  • Home loan enquiries: your details and loan requirements may be shared with our partner banks and lending institutions so they can process your request and contact you with offers.
  • Once shared, the recipient handles your details under their own responsibility. If a recipient misuses your data, report it to us through the Grievance Redressal page and we will act on it.

4. Other Sharing

  • Service providers that run the portal for us: hosting and infrastructure providers, the WhatsApp Business API (Meta) for OTP and messages, and email delivery services.
  • Analytics and advertising tools: Google Analytics, Microsoft Clarity, Meta Pixel and Conversions API, and Umami (privacy-friendly analytics). These help us understand usage and measure our advertising. Some of these providers may process data outside India.
  • Legal: courts, law enforcement, or regulators where the law requires it.
  • We do not sell your personal data.

6. Consent and Its Withdrawal

  • When you register, you accept our Terms of Service and Privacy Policy with an explicit, unticked checkbox. We store the timestamp of your acceptance as proof of consent.
  • Every enquiry form records your consent along with the enquiry.
  • You may withdraw consent at any time by writing to [email protected]. Withdrawal does not affect processing already carried out, and some processing (for example fraud prevention and legal record-keeping) may continue where the law permits.

7. How Long We Keep Data

  • Account, listing, and enquiry records: for as long as your account is active, and afterwards as needed for disputes, fraud prevention, audits, and legal obligations.
  • Page-view and usage logs: automatically deleted after about 13 months.
  • In-app notifications: removed 90 days after you read them, and in any case within 365 days.
  • Expired or archived listings may be retained internally for moderation history even after they stop being publicly visible.

8. Your Rights Under the DPDP Act, 2023

  • Access: ask us what personal data of yours we hold and how it is used.
  • Correction and updating: fix inaccurate or incomplete data — much of it you can edit yourself in your dashboard.
  • Erasure: ask us to delete data that we are not required to retain by law.
  • Grievance redressal: raise a complaint through our Grievance Redressal page; if unsatisfied with our response, you may approach the Data Protection Board of India.
  • Nomination: nominate a person to exercise these rights on your behalf in the event of death or incapacity.

9. Security

We use encrypted connections (HTTPS), role-based access controls, audit logs for administrative actions, and database-level access policies. No internet service can promise absolute security, but if a breach affects you we will notify you and the authorities as the law requires.

10. Children

Propsell is meant for adults (18 years and above) entering lawful property transactions. We do not knowingly collect children's data.

11. Changes to This Policy

We update this policy when our practices or the law change, and revise the date at the top. Material changes will be announced on the portal.
